“2 gives” na 13th month pay, kailangang pagkasunduan ng employer at employee

Walang nakikitang problema ang Department of Labor and Employment (DOLE) sa pagbabayad ng mga kumpanya ng 13th month pay sa kanilang mga empleyado nang “2 gives” o paghahati ng bayad sa dalawang installments.

Pero iginiit ni Labor Secretary Silvestre Bello III na dapat ay pag-usapan at pagkasunduan ito ng mga empleyado at mga employer.

“If the employee agrees, there is no problem. The law on 13th month pay is a benefit that is intended for the employee. When the employee says, ‘Go ahead I can wait until next year [for the 2nd installment]’, there is no problem then,” paliwanag ni Bello sa isang virtual forum na iniulat ng Philippine News Agency (PNA).

Ayon kay Bello, naiintindihan niya ang hirap na nararansan ng mga employer, pero kailangan pa ring sumunod sa batas.

“This is a statutory obligation. We cannot avoid that, we have to pay it. If you don’t pay that, the employee will definitely file a case. So I advise our employers that they can talk to their employees,” dagdag pa ni Bello.

Sa ilalim ng Presidential Decree 851, ang mga employer ay obligadong magbayad ng 13th month pay bago ang Disyembre 24.
